Is California's Section 8 Mandate Unconstitutional?

A key part of this discussion comes from a recent New York appellate court decision, where a panel of judges unanimously affirmed that a similar law was unconstitutional. So what exactly was struck down?

The law made it illegal for landlords to refuse tenants simply because they use a Section 8 voucher. But the court looked deeper and said—this isn’t just about payment.

To accept Section 8, landlords are required to participate in a government program, which includes mandatory inspections and allowing government officials into the property.

That’s where the problem came in.

The court ruled that this effectively forces landlords to submit to warrantless inspections, which are considered searches under the Fourth Amendment—based on the Supreme Court case Camara v. Municipal Court (1967).

So by requiring landlords to accept Section 8, the law was essentially saying:
👉 You can rent your property—but only if you give up certain constitutional rights.

The court said that’s an unconstitutional condition, and struck the law down—and that ruling was confirmed in a unanimous appellate decision.
