AB 1482 Rent Cap & Just Cause
California’s Tenant Protection Act of 2019 (AB 1482) places limits on how much landlords can increase rent each year and requires “just cause” for certain evictions.
Under this law, annual rent increases are capped (typically at 5% plus inflation, up to a maximum limit), and landlords must provide a valid reason for terminating a tenancy after a tenant has occupied the property for a specified period. Not all properties are subject to AB 1482, but many single-family and multi-family rentals are covered.
Rent Increase Laws
In addition to statewide rent caps under AB 1482, California law outlines specific requirements for how and when rent increases can be implemented.
Landlords must provide proper written notice depending on the amount of the increase, and increases must follow both state and any applicable local regulations. Failing to follow correct notice procedures can result in delays or legal complications.
Security Deposit Laws
California has strict rules governing how much landlords can collect for security deposits and how those funds must be handled.
Limits are placed on the total amount collected, and landlords are required to follow specific timelines and documentation requirements when returning deposits. Deductions must be itemized, and improper handling of security deposits can lead to disputes or penalties.
Eviction Notice Rules
Evictions in California must follow a formal legal process, beginning with the correct notice being served to the tenant.
Common notices include 3-day, 30-day, or 60-day notices, depending on the situation. Each notice type has specific requirements for wording, delivery, and timing. Errors in the notice process can delay or invalidate an eviction, making accuracy critical.
